The following terms and conditions (together with any documents referred to in them) represent a contract between you and Xchanged Inc. (“XCHANGED”) and apply to your use of www.xchanged.me/userportal/login, including any content, functionality and services offered on or through our website for purposes of making an online money transfer payment to a designated recipient. A "money transfer" is defined as the transmission of funds to a designated recipient, pursuant to payment terms entered directly by you into the website.

The terms "XCHANGED", "we", "us", and "our", as used throughout this User Agreement, refer to Xchanged Inc., together with its employees, consultants, directors, successors, affiliates, and assignees. The following terms: "you" and "your" refer to the users of the site. XCHANGED may make future changes or modifications to this User Agreement at any time without notice and your subsequent viewing or use of our site will constitute to your agreement to the changes and modifications.

By using this website, you represent and warrant that you are 18 years or older and of legal age to form a binding contract with XCHANGED. By registering, you agree to provide accurate and current information about yourself. Furthermore, you agree to: maintain and promptly update your online profile information to keep it current, assist us in investigations and cooperate in providing us additional information when needed. XCHANGED reserves the right to verify your information prior to approving your registration.

We reserve the right to withdraw or amend this website, and any service or material we provide on the website, in our sole discretion without notice, except as otherwise required by law. We will not be liable if, for any reason all, any part of the website is unavailable at any time or for any period. We do not warrant that the functions contained in the Service will be uninterrupted or error-free and we shall not be responsible for any service interruptions including but not limited to power outages, system failures or other interruptions that may affect the acceptance, receipt, processing or completion of your order. From time to time, we may restrict access to some parts of the website, or the entire website, to users, including, but not limited to registered users.

You are responsible for ensuring that all persons who access the website through your mobile phone device or internet connection are aware of these terms of use, have agreed to the terms of use, and that they comply with them. To access the website or some of the resources it offers, you may be asked to provide certain registration, identification and authentication details or other information. It is a condition of your use of the website that all the information you provide to us on the XCHANGED website or Android or IOS app is correct, current and complete at all times.

If you become a registered user of our money transfer service and you choose, or you are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. You agree to immediately notify us of any unauthorized use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You agree that you are only allowed to create and maintain one registered user account. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any user identification code or password, whether chosen by you or provided by us, in our sole discretion for any or no reason, including, if in our opinion, you have failed to comply with any provision of these Terms of Use.

In ordering this transfer or payment order, the sender/purchaser understands that we will promptly place with a telegraph or cable company or by electronic means, by air or regular mail our message to a correspondent or agency of our choice, and agrees we shall have fully performed our duties and obligations upon placing or mailing of such message.

That no liability shall attach to us for the delays, errors, acts or omissions of the telegraph or cable company, mail, service, or such correspondents or agencies, or for their failure to identify the payee, and that we are not responsible for any loss or damages as a consequences of any causes beyond our control including but not limited to fortuitous events, labor/social unrests and all other controllable man-made events such as power, communications, internet connections, interruptions, etc.

If for any reason payment is not made, it is agreed that refund will be made only after confirmation of cancellation of the transfer or order has been received from said correspondent or agent and we are in possession of the funds transmitted, less any charges and expenses. Likewise, other charges that may be imposed by your depository bank shall not be our responsibility.

You must contact us within 180 days from the date we promised to you that funds would be made available to the recipient either by phone or in writing.

You have the right to dispute errors in your transaction. If you believe there is an error, contact us within 90 days at 1(671)8887363. You can also contact us for a written explanation of your rights relative to your remittance transaction with us at 543A N Marine Corps Drive, Tamuning, Guam, 96913. We are not, however, responsible for errors committed by you such as wrong name of beneficiary and address/bank account number. On a reasonable effort basis, we shall try to retrieve funds credited or paid to other recipients as a consequence of your erroneous instruction.

You can cancel for a full refund within 30 minutes of payment unless the funds have been delivered, picked up or deposited to the account in accordance with your instructions.

When you initiate and submit a money transfer transaction on the website, you authorize us (or its designated agent) to charge your designated credit card account or debit your designated debit card or bank account for the amount of such money transfer transaction and our associated service charge. You are responsible for ensuring that your designated payment method has sufficient funds or credit available for payment of your money transfer transaction. You authorize us to initiate debit and credit entries to your bank account and your e-wallet in connection with the money transfer service. You also authorize us to initiate credits and debits on your e-wallet to correct errors. This authorization shall remain in full force and effect until we have received notification from you of its termination; you may revoke your authorization only by notifying us. You agree that all transactions authorized by you shall comply with all applicable federal, state and foreign law.

Money transfers that have been authorized by a user shall be processed only on the condition that the issuer of the respective credit card or debit card, or the user's bank, has authorized the corresponding charges or debits. Each user using the service acknowledges and agrees that the Company is authorized to charge the respective credit card or debit card, or debit the respective bank account, for the principal amount of the money transfer, the service charge, and any other applicable fees. The issuing bank for your credit card or debit card or the financial institution where your bank account is open may also have terms and conditions that apply to your use of the credit card, debit card or bank account (as applicable) and you must refer to such agreement(s) in order to determine user's rights, obligations and liabilities as a cardholder or account holder, which may include the assessment of cash advance or other fees. Money transfer receipts will not display fees assessed by user's bank or the issuer of user's credit card or debit card.
